Terms of Service

1. Agreement to Terms

By accessing or using OurChapter ("Service", "Platform", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use our Service.

These Terms constitute a legally binding agreement between you and OurChapter, operated from Greece.

2. Description of Service

OurChapter is a web-based platform that allows users to create interactive love story pages featuring:

• Text content with customizable themes and music
• Image galleries and media uploads
• Interactive quizzes and choices
• Lock screens with custom unlock codes
• QR code generation (paid tier)
• Custom subdomain URLs (paid tier)

3. Account Registration and Usage

3.1 Eligibility

You must be at least 16 years old to use our Service. By creating an account, you represent that you meet this age requirement and that all information you provide is accurate and current.

3.2 Guest Usage

You may explore and build pages without creating an account ("Guest Mode"). Guest pages are stored locally in your browser using browser storage and are not saved to our servers. To publish a page, you must create an account. Upon registration, you may import your guest page data.

Guest page data stored in your browser may be lost if you clear your browser data, use incognito/private browsing mode, or access the service from a different browser or device. We are not responsible for loss of guest page data.

3.3 Account Security

You are responsible for maintaining the security of your account credentials. You agree to:

• Keep your password confidential
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account

4. Service Tiers

4.1 Free Tier

The free tier includes:

• 1 page per account (any template)
• Maximum 2 story sections per page
• Maximum 2 quiz sections per page
• Maximum 2 images total per page
• Standard URL: /p/[userId]/[slug]
• OurChapter branding watermark

Content limits (story sections, quiz sections, images) are strictly enforced. When you reach a limit, you will be prevented from adding additional content of that type until you upgrade to Premium.

4.2 Paid Tier

The paid tier ($19 one-time payment) includes:

• 2 pages per account:
  • 1 year-round page (Anniversary or Birthday template)
  • 1 seasonal celebration page (Valentine's, Christmas, Easter, Halloween, or Summer template)
• Unlimited story sections per page
• Unlimited quiz sections per page
• Unlimited images per page (soft limit: 100 images or 500MB per page for performance)
• Custom subdomain: name.ourchapter.app
• QR code download feature
• No branding watermark

4.3 Tier Restrictions and Enforcement

Tier limits are strictly enforced at the account level. When you reach your plan's page limit, you will be prevented from creating additional pages until you either:

• Delete an existing page to make room for a new one (within the same category for paid tier), or
• Upgrade to a higher tier (free to paid)

For paid tier users, the two page slots are categorized by template type:

• Year-round slot: For Anniversary or Birthday templates
• Seasonal slot: For Valentine's, Christmas, Easter, Halloween, or Summer templates

You may delete and recreate pages within your plan limits at any time. However, deleted page data is permanently removed and cannot be recovered.

We reserve the right to modify tier features and pricing with 30 days advance notice.

5. Payments and Refunds

5.1 Payment Processing

Payments are processed securely through our payment provider. By making a purchase, you authorize us to charge your payment method for the agreed amount.

5.2 Refund Policy

Given the digital nature of our service and the immediate access provided:

• Refunds are available within 7 days of purchase if you have not published your page
• Refunds are not available once a page has been published or if custom subdomain has been activated
• To request a refund, contact us with your order details

5.3 Promotional Codes

Promotional codes may be offered at our discretion. They cannot be combined with other offers, transferred, or exchanged for cash.

6. User Content and Conduct

6.1 Your Content

You retain ownership of all content you create and upload ("User Content"). By using our Service, you grant us a worldwide, non-exclusive license to host, store, display, and deliver your User Content as necessary to provide the Service.

6.2 Content Restrictions

You agree not to upload or create content that:

• Violates any laws or regulations
• Infringes intellectual property rights of others
• Contains malware, viruses, or harmful code
• Is defamatory, obscene, or pornographic
• Promotes violence, discrimination, or illegal activities
• Contains personal information of others without consent
• Impersonates any person or entity
• Harasses, bullies, or threatens others

6.3 Content Moderation

We reserve the right (but are not obligated) to review, monitor, and remove User Content that violates these Terms. We may suspend or terminate accounts that repeatedly violate our content policies.

6.4 Copyright Infringement

If you believe your copyright has been infringed, please contact us with:

• Identification of the copyrighted work
• Location of the infringing material
• Your contact information
• A statement of good faith belief
• A statement of accuracy under penalty of perjury
• Physical or electronic signature

7. Prohibited Activities

You agree not to:

• Attempt to gain unauthorized access to our systems
• Use automated tools to access or scrape the Service
• Reverse engineer, decompile, or disassemble any part of the Service
• Interfere with or disrupt the Service or servers
• Circumvent usage limits or restrictions
• Use the Service for commercial purposes without our permission
• Resell or redistribute the Service
• Create multiple accounts to bypass limitations

8. Intellectual Property

The Service, including its design, code, features, and branding, is owned by OurChapter and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

9. Third-Party Services

Our Service integrates with third-party services (authentication, media storage, hosting). Your use of these services may be subject to their own terms and privacy policies. We are not responsible for third-party services or their availability.

10. Disclaimers and Limitation of Liability

10.1 Service Availability

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, secure, or error-free.

10.2 Limitation of Liability

To the maximum extent permitted by law, OurChapter shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the Service.

Our total liability for any claims related to the Service shall not exceed the amount you paid us in the past 12 months, or €100, whichever is greater.

10.3 Data Loss

While we implement backup procedures, we are not responsible for data loss. You are responsible for maintaining your own backups of important content.

11. Indemnification

You agree to indemnify and hold harmless OurChapter, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your violation of these Terms
• Your User Content
• Your use of the Service
• Your violation of any rights of another party

12. Account Termination

12.1 By You

You may delete your account at any time through your account settings. Upon deletion, your User Content will be removed within 30 days. Paid subscriptions are non-refundable upon termination by you.

12.2 By Us

We may suspend or terminate your account if you:

• Violate these Terms
• Engage in fraudulent activity
• Pose a security or legal risk
• Have not accessed your account for over 2 years (free tier only)

We will provide reasonable notice before termination unless immediate action is required for legal or security reasons.

13. Modifications to Service and Terms

We reserve the right to modify or discontinue the Service, or any part thereof, with reasonable notice. We may also update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the modified Terms.

For material changes, we will notify you via email or prominent notice on the Service at least 30 days before the changes take effect.

14. Governing Law and Disputes

14.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Greece and the European Union, without regard to conflict of law principles.

14.2 Dispute Resolution

Any disputes arising from these Terms or the Service shall be resolved through:

• First, good faith negotiation between the parties
• If unresolved, mediation or arbitration in Greece
• As a last resort, in the courts of Greece

EU consumers retain the right to bring proceedings in their country of residence.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and OurChapterregarding the Service and supersede all prior agreements and understandings.
